Mortgage Default Notice: Checks and Next Steps

Read a mortgage default notice, verify the account and response details, organise lender contact and know when legal or financial help is needed.

A mortgage default notice tells a borrower that the lender says they have breached their loan or mortgage obligations and must respond. If your client brings you one, verify the document, copy its requirements and arrange prompt lender contact and legal help.

Mortgage default commonly means missed repayments, although another breach can also trigger a notice. A notice of default is a warning within a recovery process. Receiving one doesn’t mean the lender has already obtained a court order or sold the property.

Your role at this stage is to organise the facts and referrals. A lawyer must assess the notice’s validity, service and legal consequences. Don’t wait for a refinance application to resolve the immediate problem.

Identify the Notice and Account

Match the complete notice to your client’s loan before you discuss payment or send personal information. Keep every page and attachment, together with the envelope or original email.

  1. Record the sender’s name and whether it claims to act for the lender. Copy any solicitor or collections reference.
  2. Match the borrower names, loan number and secured property address to the mortgage file. Note any mismatch without changing the notice.
  3. Record the issue date, when the client received it and how it arrived. Keep postal markings or email delivery details.
  4. Copy the stated default. Record whether it concerns arrears, another loan condition or more than one alleged breach.
  5. Contact the lender through a number from its official website, your established broker channel or an existing account statement. Ask it to confirm the notice and any appointed representative.

The verified lender channel must confirm payment instructions before the client uses account details printed in the notice. A familiar logo or correct property address alone doesn’t establish authenticity.

What a Section 88 Default Notice Means

A section 88 default notice, sometimes called an s88 notice, is a notice under the National Credit Code. The Code is Schedule 1 to the National Consumer Credit Protection Act 2009.

Section 88 of the Code, in the 1 July 2026 compilation, sets conditions before enforcement of covered credit contracts and mortgages. Its ordinary notice requirement gives at least 30 days from the notice date to remedy the default. The section also contains exceptions.

The label alone doesn’t establish that the Code applies, that the notice complies or that service was valid. Other laws can also govern the mortgage. Give the complete document to a lawyer for those questions, including any disputed response date.

Mark Items for Urgent Confirmation

Copy every amount, required action and stated date into a short record, keeping the document’s wording beside your questions. Record dates as printed without calculating the last legal day yourself.

Ask the lender to reconcile the claimed arrears with recent payments. A receipt can show a payment that hadn’t reached the account when the notice was prepared. Keep both records until the lender explains the difference.

For example, a fictional notice lists $4,800 in arrears, while the client has a receipt for a later $1,200 payment. Record both amounts and send the receipt through the verified lender channel. Don’t mark the notice resolved or reduce its demand yourself.

Home Loan Default Notice Periods and Enforcement

The general section 88 period doesn’t let you work out a particular client’s last response day from memory. Keep the notice’s dates visible and get legal advice promptly if timing is unclear or the stated date has passed.

Moneysmart’s mortgage arrears guidance, updated 2 October 2026, explains that unresolved default can lead to legal action and repossession. A statement of claim, summons, notice to vacate or sheriff’s letter needs urgent legal attention.

A mortgagee sale means a lender sells the secured property to recover debt. The sale can leave an unpaid balance. People also use “foreclosure” when discussing loss of a mortgaged home, but a lawyer must identify the actual process from the documents.

Does a Default Notice Affect a Credit Score?

Receiving a notice doesn’t by itself prove that a default has been listed on the client’s credit report. Missed repayments and a default listing are different kinds of credit-report information.

The Office of the Australian Information Commissioner’s repayment and default guidance, as at October 2026, sets separate conditions for listing a default. These include at least $150 overdue for at least 60 days and required notices before disclosure.

Repayment history can already show missed payments, so the absence of a listed default doesn’t establish a clean repayment record. Obtain the client’s credit report through an authorised process and compare it with the lender’s records. Don’t promise a particular credit-score change or automatic deletion after payment.

Prepare the Lender Conversation

Prepare a factual summary for the lender’s authorised hardship or collections team, with your client’s consent to discuss the account. Ask the lender what authority it needs before speaking with you.

Gather current income evidence and a realistic account of expenses. Add the reason repayments fell behind, recent payments, earlier hardship requests and any responses. Record what the client wants, such as help catching up on arrears or discussing a sustainable repayment arrangement.

Use the conversation to obtain clear account information and a written response.

  1. Confirm the loan and notice reference through the verified channel.
  2. Explain the client’s difficulty and requested outcome. Ask which team is handling the notice and any hardship request.
  3. Ask for the current arrears calculation and required documents. Record any disagreement or missing payment.
  4. Request written confirmation of any agreed arrangement and what the lender says about the notice or enforcement status.
  5. Record the case reference, staff member and follow-up date. Send the client a factual summary and keep the lender’s response.

A request for help, a submitted document or an informal conversation isn’t proof that the lender has agreed to a pause or variation. Legal protections can depend on the type and history of a request. Ask legal assistance to assess them, and never promise approval or a suspended process.

Escalate to Appropriate Help

Arrange legal help promptly for document interpretation, disputed service or enforcement risk, alongside financial counselling when the client needs debt assistance. Don’t wait for the lender to answer before making an urgent referral.

The National Debt Helpline provides free, confidential financial counselling. Its website also has live chat. Moneysmart’s legal directory includes nationwide Mob Strong Debt Help on 1800 808 488 for Aboriginal and Torres Strait Islander peoples.

AFCA’s complaint page accepts financial-hardship concerns including default notices and continued recovery after a request for help. Court decisions and other limits can affect what AFCA can consider. When proceedings are underway, contact legal help urgently and ask AFCA about the complaint’s current position.

A lender complaint or referral doesn’t establish that a court deadline has changed. Keep legal assistance informed about new documents and lender responses.

Protect the Mortgage File

Update any active credit application with material verified facts through the responsible broker and keep the evidence behind each update. A notice received during a refinance or purchase application can change the financial position the lender is assessing.

Retain the original notice and delivery evidence. Keep the client’s consent, referral details, lender confirmations and notes of outstanding questions. Separate the lender’s stated claim from verified account facts and legal advice.

If a payment clears, record the receipt and the lender’s confirmation of its effect. If a hardship arrangement is agreed, keep the written terms. A new document needs its own dated record, even when it concerns the same account.

For later lending assessment, use the guide to home loans with bad credit history once the actual repayment and credit-report information is established. An expected refinance approval doesn’t resolve an existing default notice.

Before ending the handover, confirm that the client knows the next contact and action. Check that each urgent document has reached the appropriate service and that unresolved dates remain visible in the file. Keep following up until you have a response or a confirmed next step, without describing an unresolved notice as cleared.
