Gadens Mortgage Discharge Forms: Authority and Steps
Check whether the outgoing lender has appointed Gadens for its discharges, then find that lender's authority in the Gadens forms list and track settlement.

Gadens discharge forms are lender-specific authorities: use the form for your client’s outgoing lender and send it to the recipient that lender names. A form in the Gadens list doesn’t establish that Gadens handles your client’s discharge.
Start with the outgoing lender’s instructions and the client’s loan details. Once the correct recipient is confirmed, obtain the authority, arrange the required signatures and retain the lodgement reference for settlement follow-up.
What Gadens Does in a Discharge
When a lender appoints Gadens for a discharge, the firm handles the legal work within that appointment, including discharge preparation and settlement participation. The lender remains the mortgagee, the party holding the mortgage over the property. The lender sets the authority’s requirements and the conditions for releasing its security.
Gadens is a law firm with a broader practice. Its banking and finance service covers work for lenders and borrowers. A Gadens lawyer acting for someone in a purchase or dispute isn’t automatically the contact for an outgoing lender’s discharge.
For historical context, Property Exchange Australia (PEXA), the electronic settlement platform, described Gadens Brisbane completing mortgage discharges in June 2016. That account establishes a discharge role at that time. It doesn’t identify the appointed firm for today’s client file.

Confirm the Lender Uses Gadens
Confirm Gadens’ appointment from the outgoing lender’s instructions for the client’s loan before sending a signed authority or personal information. You need the lender’s name, loan account details and property address, plus the client’s permission to deal with the discharge.
- Read the lender’s current discharge instructions. Start on the lender’s own website or with the loan servicer named on the client’s statement. Identify who receives the authority and who handles settlement.
- Check the client’s correspondence. Look for a named Gadens team in the payout letter or discharge instructions. Match the loan and property details so a contact for another matter isn’t used.
- Resolve conflicting directions with the lender. If a Gadens listing points one way and the lender’s instructions point another, ask the lender’s discharge team to confirm the recipient for this loan. Retain its written direction before lodging.
For example, in a hypothetical refinance, a form library contains the lender’s form but the lender directs authorities to its own discharge team. The broker sends the signed authority to that team. Gadens becomes the settlement contact only if the lender identifies it for that work.
As the broker, route the client’s authority to the party the lender names. A listing is a way to find a document, not a substitute for the lender’s instructions. Use the lender discharge guides when the client has loans with more than one lender.
Find the Lender’s Form in the Gadens List
Use the Gadens discharge authorities list to locate the outgoing lender’s form, then compare it with the lender’s current version. The list is a forms library covering multiple lenders, so select by lender identity rather than by the Gadens name alone.
- Find the lender named on the client’s loan. Open its discharge authority and check the lender or mortgagee identified inside the document. For a loan with a separate servicer or brand, use the lender’s instructions to establish which form applies.
- Compare versions before completing the form. Check any issue date or version code against the authority on the lender’s own website. A recent download date doesn’t prove a document is the current version.
- Resolve a version mismatch before signing. Obtain the version the lender accepts for this loan if the documents differ. If neither has a visible version date, compare the instructions and ask the lender to identify the accepted authority.
- Read the return instructions in the accepted form. Record the receiving team and submission method before arranging signatures. If the list doesn’t load or the lender isn’t listed, obtain the authority through the lender’s own discharge route.
A correct selection produces an authority that identifies the client’s outgoing lender and covers the required loan and property. Complete the fields and signature requirements in that authority. Avoid reusing a signed form for a different lender or assuming every form in the library goes to Gadens.
Lodge, Book Settlement and Track
Lodge the accepted authority through the return route printed on the form, subject to any updated written instructions from the lender. That route determines whether the receiving team is the lender, Gadens or another appointed firm.
- Submit the completed authority. Use the stated email, portal or other return method and include any attachments the instructions require. Retain the exact signed version and evidence of when and where it was sent.
- Confirm receipt and acceptance. Keep the discharge or matter reference, the receiving team’s details and any outstanding requirements. A successful email delivery or upload alone doesn’t establish that the authority has been accepted.
- Arrange settlement through the appointed contact. Give the client’s solicitor or conveyancer the reference and the lender’s settlement contact. Have that representative confirm the proposed date and booking with the party handling the outgoing discharge.
- Confirm the payout for that settlement date. Track who is providing the payout figure and whether any outstanding item prevents it being issued. If the date changes, request confirmation of the figure and booking for the revised date.
If the authority is rejected, ask the receiving team for the exact reason. Compare that reason with the submitted form, correct the missing field or signature and retain the replacement version. When Gadens is the appointed contact, use its matter reference so the enquiry reaches the team handling the discharge.
If the payout figure is missing, contact the lender’s nominated payout or discharge team. When Gadens handles that request under the lender’s instructions, follow up with the assigned Gadens team. Include the lodgement reference and proposed settlement date, and ask what remains outstanding.
